Liability and Field Trips

One of the best things about our community is the willingness of parents to participate in field trips. Parents have also been more than willing to carpool, driving other children on these trips.

Our local school attorney, however, has just advised against this due to the liability it could place on the school and those parent drivers. See below an excerpt from her advice:

In case of an accident and possible harm caused to a student, a court might come to the conclusion that organizing the transportation with non-professional drivers and vehicles should not have taken place, and that the conduct of the school was attributable and may not therefore be relieved from liability. Therefore, from a liability point of view, travel by professional bus is definitely recommended.”

We will only use buses on field trips from now on based on our attorney’s recommendation. This is unfortunate, but less risky, according to her.
